La defensa argumentó que el lonko no se encontraba a la hora ni en el lugar donde estaban las cabañas, presentando además testigos que dieron fe que él estaba en otro sector de la comunidad.
Avelino Meñaco salió en libertad sin medidas cautelares, ya que el montaje en su contra no tenía consistencia.
